Both types of promotion are similar in that they offer the chance to win cash or non-cash prizes through a prize draw. But what is the difference between them? Promotional lotteries can be entered free of charge by purchasing the promoted product, service or other „proof of entry”. Participants must be aged 13 or over. Participation in an audiotext lottery is subject to a charge, as it involves sending an SMS message (or making a phone call). Participants in this game must be of legal age.

Promotional and audiotext lotteries

Participants in promotional and audiotext lotteries are motivated by the desire to win a prize in the form of a product or cash. The organisers of such campaigns, in turn, hope to boost sales of the product or service on offer, strengthen brand recognition, or generate revenue from, for example, text messages or telephone calls.

Both the rules governing promotional lotteries and audiotex lotteries are set out in the Gambling Act. The process of organising them is quite complex and involves administrative procedures carried out before the Head of the Customs and Tax Office, the Heads of Tax Offices and the Director of the Tax Administration Chamber. Furthermore, the organiser is subject to a number of other requirements which must be met. These include, amongst other things, the need to prepare full documentation, to provide a bank guarantee for the payment of prizes, and to have no outstanding tax liabilities, etc.
