In Poland, four types of lottery may be organised: promotional, audiotext, raffle and cash lotteries. The latter are subject to a state monopoly, and the rules governing all of them are set out in the Act of 19 November 2009 on gambling, together with its implementing regulations.

Promotional lotteries, audiotext lotteries and raffle lotteries are similar in that they all offer the chance to win prizes through a draw. But what sets them apart? In promotional and audiotext lotteries, participants can win both product prizes and cash prizes. In the case of charity raffles, only non-cash prizes are awarded, and all proceeds are donated to charitable or socially beneficial causes.

How old do you have to be to take part in the lottery?

Importantly, in raffle lotteries – as in promotional lotteries – individuals aged 13 or over may take part. This follows from the provisions of the Act, specifically Article 27(2), and the Civil Code, which sets out guidelines on legal capacity. It should also be emphasised here that, in the case of audiotext lotteries, the rule applies that participants taking part in the game must be of legal age.
