Audiotext lotteries, as referred to in Article 2 of the Gambling Act, are defined as games of chance. They are characterised by prizes in kind or cash, and the results of the game depend solely on chance.

How does an audiotext lottery work?

Only adults may take part in audiotext lotteries. Participation takes place via premium-rate telephone calls or by sending premium-rate text messages. From the participant’s perspective, the aim of taking part in a lottery is to win a prize in kind or cash, whilst for the organiser, the motivation is to increase sales of the promoted products and services.

In addition to audiotext lotteries – in accordance with the Gambling Act – promotional and raffle lotteries may also be organised in Poland (open to participants aged 13 and over). Cash lotteries are subject to a state monopoly.
